Can a bailiff use a locksmith to gain entry to my house?

I found a note pinned to my front door stating that a certified bailiff had attended to execute a distress warrant against me (£895 which i cannot afford). The note then states that they have the authority to force entry to my house, via a locksmith, under Schedule 4A of the domestic violence, crime and victims act to execute the warrant. Is this true? I thought a bailiff could only force entry if they had previously gained entry or if it was for a debt regarding tax or rent.

    If in doubt call the police, if i turned up at your door said i was a court appointed bailiff should you let me in or use your legal right to refuse entry to somebody you don't know or has no proof of who they actually are. If somebody tried to kick your door in and they don't identify themselves you have the legal right to use whatever means at your disposal to stop them getting in. Call the cops if they come round again. By the way professional locksmiths dont use sledge hammers to gain entry. If you see sledge hammers they aren't legit court appointed collection agents they are private collection agents you can stop them gaining access to your property until the police arrive. I'm from the north of Ireland we have no private collection companies or agents for obvious reasons but if somebody said they were from the courts and tried to gain access with no police present, sorry me lad but your fair game for a ball pein hammer in the face.

    There's two possibilities:

    1) You have received a summons to attend Court and either ignored it or refused to cooperate. The Court has issued a distress warrant and the bailiffs are going to come and take away your goods. You could go to the Court and ask for a stay of the warrant, but they'll only grant this if there has been some irregularity - like the summons was not issued correctly.

    2) This is a trick by a firm of debt collectors pretending to be Court appointed bailiffs to frighten you into paying a debt they've bought. If you think this is the case, first check with your nearest County Court to make sure that no distress warrant was issued. Then contact the Trading Standards department of your local authority. They will prosecute the debt collectors - impersonating a bailiff is a criminal offence.

    Debt collection bailiffs are only used if you have made no effort at all to pay some or all of your debt. However hard it may be you need to do something about it.

    CAB will start you on your way with debt management etc. Make some effort and demonstrate that you are doing so. Finally, and I am not totally sure about this but I am given to understand that they can only execute a warrant in the presence of a Police officer.

    Yes they can and they will and add fees for thier pleasure too!

    What i advise is for you to contact them (they are usually only reahable on 0845 numbers which makes it worse!) And explain you were genuinely out the first time they called and arrange a payment plan with them, alot of bailiff will accept this but it will probably be quite a big amount maybe weekly!

    but if you pay them a starting amount then it shouldnt be as bad.

    What ideally should have happened is you should have contacted the company you had the debt with when they first alerted you to it or when they first threatened action, you could have arranged a much easier repayment with them then and not have eatra fees added by the debt collection company :(

    yes they can that is why the note was pinned to your door they have court authority to enter your premises to execute a warrant if they cant gain entry any other way

    Yes.. it's the Law ..best thing you can do is to move all your stuff cos they wiil take everything and sell it for a pittence...I know a bloke who owed £450 they took his £675 TV and sold it for £50 and he still owed the balance of £400 so get moving.....

    Yes they can. I have seen it in action before. Best bet add more locks and bolts to prevent them from entering your home or get an anti intruder device fitted. Buy pepper spray and blind the t***s when they try to force there way in as you still have the right to defend your property lol
