Can a state be expelled from the Union?

With all the financial problems that California is facing could it come that?

    No. The only way a state can legally secede from the Union (this is for ALL states, including Texas) is with the consent of both the state legislature and Congress.

    And, California's financial problems are California's, not the federal government's responsibility. Why would the federal government expel them for this?

    *EDIT* - There is nothing in the Constitution about states seceding, but, I could see it possible that the Court would extend Article IV, Section 3 in include this ("...nor any State be formed by the Junction of two or more States, or parts of States, without the Consent of the Legislatures of the States concerned as well as of the Congress").

    But no, a State can't be expelled from the Union.

    I guess the Federal Government could cut off funds to California if they decided that was a good plan.

    BTW I live in California, and have no plans to move; I'm just thinking what it might be like if we became our own nation [weird].

  • No, there is no provision in the Constitution for any state to leave the union, voluntarily or otherwise.

    Besides, California's problems aren't the concern of the rest of the nation, so why eject them?

    Texas, for the uninformed up at the top, never has had, and certainly does not have NOW, any right to secede. They tried that in 1861, remember?

    A war does not decide a legal question. It is possible that a state can petition for the right to secede and make an argument based on the law that is has the right. It was discussed in the Federalist papers and many agreed there was a right to secession.

    BTW, Texas has the right by treaty of annexation with the U. S. to break itself into five states.

    No....unless they choose to secede first.....and the only state that has such language in its own state constitution is TEXAS.All others would be subject to martial law.
