I would guess that if a surrogate had sex with someone and was given money, that in and of itself would be considered prostitution by law

No. Prostitution is the act of selling your body/sex for money. Surrogacy is providing a womb for the baby to grow in to full term that is not that of the person who is wanting to have the child. Sometimes people want to have a child, but maybe the woman cannot carry the child due to medical issues, or maybe her body just doesn't provide the proper environment to carry a child to term. This gives couples an alternative way to have a child in those instances. A lot of times it involves in-vitro as well.
