  • what is my termination notice period?

    Dear lawyers, I need help!

    I work for a very large US multinational company in their Singapore office, since mid 2006. 1 month ago I submitted my resignation and give 1 month notice, as it was specified in my employment contract. 1 week after, I was informed that my notice period is 2 months because I was promoted in 2007. The promotion letter says that my benefits and terms of employment are aligned to the new job grade which are specified in the HR policy, but did not highlight what are the changes. Is the promotion letter a new contract? It is only a quarter page thingy and it dont say much.

    When I was told that my notice period is 2 months, I went on a search on the company intranet to find the HR policy document. There was no such document. I searched everywhere and used keywords to try locate this document, but it was not to be found. Then I ask the HR personal if they would send me the document or the link, and they would not send it at 1st. I had to ask for it 3 times before they point me to a portal system and only by searching for the document by the document number, that I found the policy document. It was a document whose scope is limited to behaviors and termination notice periods. There should be other HR policy documents that cover other aspects of employment and benefits, but not knowing the document numbers, means that I can not get access to read them.

    Anyway, the document says, "the termination notice period shall be as follows, unless otherwise stated in the employment contract"... and it says 2 months for the grade that I am currently working in.

    I have many questions

    1) What is my notice period? As stated in the employment contract or as stated in the HR policy?

    2) Should I be informed in writing about the changes in the terms of employment?

    3) Since the HR policy says "unless otherwise stated in the employment contract... " so it actually reverts back to the only employment contract which I signed in 2006, right?

    Additional info, employees are never informed when HR policy are changed. Does this make a difference?

    Now, they are demanding that I pay 1 month salary in lieu of notice... .. so I need help.. to understand what is right.

  • Is it useful for victim to report snatch thieves in JB Malaysia?

    While fueling up today at a Shell station, 2 men on motorbike opened the front passenger door and grabbed my pouch. I saw them coming but couldnot lock car in time. Then I ran a few steps after them and just managed to get license plate #. I could remember the face of the rider, but the pillon was too fast for me. BTW, the thieves plate # is JDE8287. The rider is middle aged Indian with medium size moustache, the snatcher is perhaps in early 20s.

    I have filed a police report, but I wonder how effective is it going to be? What would JB police do about this? Can they arrest the owner of the bike if it was not previously reported stolen?
