Help with immigration?

Can anyone help me? I have a friend who has been living here in the UK for the past 9 years illegally.

I recently visited his family whilst on vacation and found his mother to be seriously ill with cancer, they pleaded with me not to tell my friend about his mother as they knew he would come straight home and not be able to get back in to the UK.

So I'm stuck in the middle and don't know what to do for the best, someone told me that if you've been here (UK) for five years you're entitled to a passport, is this true? and if it is true do you have to have been here legally for five years?

If anyone could point me in the right direction I would very much appreciate it!

    if u r in UK for 10 years illegally u can apply for indefinite leave to remain,not the passport.after getting ILR you have to wait for 1 year to apply for passport.

    but u have to prove that u stayed in this country for 10 years,you can give bank statements,bills,salary slips etc dated back to 10 years.

    again u have no legal right to get ILR.it is up to the discretion of the immigration officer.

    u have to wait for another year to complete 10 years.

    i dont think that it's 5 years. Maybe if he was legal then yes. I know that if you are here illegally for 13 years (strange number I know) then you have the right to apply for indefinate leave to remain in the UK. However, that would depend on the circumstances and you would surely have to prove why you should stay here.

    If I were you, I would have to tell my friend. I mean, how could you keep that to yourself. Think if you were in his situation, you would want to know. He may go as he wouldnt want to miss time with his mother if she is dying. He probably wont be able to return to the UK then, but he wont havemissed time with his mum.

    If you have been in the UK legally yes. Your friend is an illegal immigrant and is not entitled to anything let alone a British passport.

    You don't get a passport for breaking the law?

    I'm sorry for their situation but it's of their own making by breaking UK law.

    You have to be here legally for 5 years in order to apply to be naturalised and then apply for a passport.

    There is really no way that your friend can obtain a visa within the UK given his status just now - he would need to exit the UK and then re-apply to enter.

    I suppose he could be eligible to apply for asylum if he fits the criteria.

    it depends...if your friend is an EEA member he can apply for british naturalisation provided that he can prove he lived here legally for 6 years (not 5 years as the home office usually states in their webpages) if he is from outside the EEA it's much more complex. I believe he is from a country outside the EEA otherwise he wouldn't be living illegally in the uk- as EEA members are automatically entitled to reside here.

    sooner or later he will have to decide what to do or he will face deportation.

    You are a good friend in a very difficult situation.

    (Its a pity that some people use this forum as a soapbox when in fact it is Q and A situation and not ment for JUDGEMENT.)

    I would tell the friend about his mother. I would recommend him to seek legal advise.

    Once he leaves, it is probable that he will not get back in. However once he finds himself back with family and in his homeland, he might not find it is as terrible as he thinks. May be a blessing in disguise.

    i am sorry about his mother. you're really a good friend . it's better that you take him for consultation to get a better information and more options to get him the legal status. this is not the right website to ask for answers of this situation.

    Looks like your friend is a criminal why on earth can anyone think that he should be given citizenship for committing a crime.And by the way you are a criminal also for aiding your friend.

    Your friend will NEVER forgive you when he finds out that you have not told him about his mother!!!

    If he is an illegal then he must be STEALING from US - not paying taxes, enjoying facilities that WE are paying for.

    Do we want this kind of person sponging off us?

    You are GUILTY of concealing an illegal immigrant and should be punished.

    Your friend must go to his dying mother and then return here legally.
